Terms of Service

1. Description of Service

Akashvahini provides personalised KP (Krishnamurti Paddhati) astrological predictions, analyses, and related content delivered via the WhatsApp messaging platform (“WhatsApp”). The Service is offered on a monthly subscription basis in accordance with the plan selected by you.

Entertainment and Guidance Only. Astrology is a traditional system of belief and interpretation. All content provided through the Service is intended for personal entertainment, reflection, and general guidance purposes only. It does not constitute professional financial, legal, medical, psychological, or any other regulated professional advice. You should not make significant life decisions, financial investments, medical choices, or legal actions solely on the basis of astrological content received through the Service. We expressly disclaim any liability arising from reliance on such content for any purpose other than personal enjoyment and reflection.

2. Eligibility

You must be at least 18 years of age to subscribe to and use the Service. By subscribing, you represent and warrant that:

• you are at least 18 years old;
• you have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
• your use of the Service does not violate any applicable law or regulation; and
• all information you provide to us is accurate, current, and complete to the best of your knowledge.

If you are accessing the Service on behalf of a legal entity, you represent that you have authority to bind that entity to these Terms, and “you” refers to that entity.

3. Account and Registration

The Service is accessed through your WhatsApp account and phone number, which together constitute your account identifier. You are responsible for:

• maintaining the security of the WhatsApp number you register with us;
• all activities that occur under your subscription, including WhatsApp interactions that purport to originate from your number; and
• notifying us immediately at legal@e3xgroup.com if you believe your account has been accessed without your authorisation.

We are not liable for any loss or damage arising from your failure to maintain the security of your WhatsApp account or to notify us promptly of any breach.

4. Subscription, Billing, and Payment

Subscription fees are charged on a monthly, prepaid basis. The applicable plans and pricing are set out in our Refund Policy. We reserve the right to amend pricing with at least 30 days' notice to you via WhatsApp or email before the change takes effect.

Payments are processed by our third-party payment processor, PAYable. By making a payment you also agree to PAYable's applicable payment terms. We do not store your full card or bank account details on our systems.

Subscription fees are displayed in Sri Lankan Rupees (LKR) and United States Dollars (USD). Your bank or card issuer may apply conversion rates and fees if you pay in a different currency; those charges are your responsibility.

Your rights regarding refunds and cancellation are governed exclusively by our Refund Policy, which is incorporated into these Terms by reference.

5. Acceptable Use

You agree that you will not, and will not permit others to:

• use the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
• resell, sublicense, share, or otherwise distribute access to the Service to any third party without our prior written consent;
• use automated scripts, bots, scrapers, or other automated means to interact with the Service or to extract content from it;
• impersonate any person or entity, or falsely represent your affiliation with any person or entity;
• transmit any material that is harassing, defamatory, obscene, unlawfully threatening, abusive, or discriminatory;
• attempt to gain unauthorised access to any part of the Service, its related systems, or networks; or
• interfere with or disrupt the integrity or performance of the Service or the data it contains.

We reserve the right to suspend or terminate your subscription immediately and without refund if we determine, in our sole reasonable judgement, that you have violated any of the above.

6. Intellectual Property

All content delivered through the Service — including but not limited to astrological analyses, predictions, charts, interpretations, algorithms, software, branding, and materials — is the exclusive intellectual property of E3X Global (Pvt) Ltd or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

Your subscription grants you a personal, non-exclusive, non-transferable, revocable licence to receive and read the content for your own private, non-commercial use only. You may not reproduce, republish, redistribute, sell, or create derivative works from any content provided through the Service without our prior written permission.

Any feedback, suggestions, or ideas you share with us regarding the Service may be used by us without restriction or compensation to you.

7. Third-Party Services

The Service is delivered through WhatsApp, a platform operated by Meta Platforms, Inc. Your use of WhatsApp is governed by Meta's own terms of service and privacy policy, which are independent of these Terms. We are not affiliated with, endorsed by, or responsible for WhatsApp or Meta.

We may use other third-party service providers (including payment processors, cloud infrastructure providers, and analytics tools) to operate the Service. We are not responsible for the acts or omissions of those third parties, except to the extent required by applicable law.

8. Disclaimers

As-is basis. The Service is provided “as is” and “as available” without any warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• merchantability and fitness for a particular purpose;
• accuracy, completeness, or reliability of any astrological content;
• uninterrupted, timely, secure, or error-free operation of the Service; and
• any outcomes, results, or events predicted or suggested by the Service materialising in fact.

Astrology is not a science and predictions are not guarantees. We make no representation that any astrological content will be accurate, and we accept no responsibility for any decisions made in reliance on that content.

9. Limitation of Liability

To the fullest extent permitted by the laws of Sri Lanka and any other applicable jurisdiction:

• E3X Global (Pvt) Ltd, its directors, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with these Terms or the Service;
• our total cumulative liability to you for any claim arising out of or related to these Terms or the Service, regardless of the legal theory, shall not exceed the total subscription fees you paid to us in the three calendar months immediately preceding the event giving rise to the claim; and
• these limitations apply even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law, including liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.

10. Indemnification

You agree to defend, indemnify, and hold harmless E3X Global (Pvt) Ltd and its directors, officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your breach of these Terms; or (c) your violation of any applicable law or the rights of any third party.

11. Termination

By you. You may cancel your subscription at any time in accordance with the cancellation process described in our Refund Policy. These Terms continue to apply until your subscription period expires.

By us. We may suspend or terminate your access to the Service immediately, without notice or liability, if: (a) you breach these Terms in any material respect; (b) we are required to do so by law; (c) we determine that providing the Service to you creates legal or reputational risk; or (d) we decide to discontinue the Service in whole or in part (in which case we will endeavour to provide at least 14 days' notice and, where applicable, a pro-rata refund of unused prepaid fees).

On termination for your breach, no refund is owed. Sections 6, 8, 9, 10, 12, and any provisions that by their nature should survive shall survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution is not reached within 30 days of written notice of the dispute, the matter shall be subject to the exclusive jurisdiction of the courts located in Colombo, Sri Lanka.

If you are a consumer resident in a country whose consumer protection laws grant you the right to bring proceedings in your country of residence, nothing in this section overrides that right.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and notify you via WhatsApp or email at least 14 days before the new Terms take effect. If you continue to use the Service after the effective date of the revised Terms, you are deemed to have accepted those changes. If you do not agree to the revised Terms, you may cancel your subscription before the effective date.

14. General

• Entire Agreement. These Terms, together with the Refund Policy and Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements, understandings, or representations.
• Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
• No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Force Majeure. We shall not be liable for any failure or delay caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, WhatsApp platform unavailability, internet outages, or third-party service failures.
